  1. We help travelers find and book vacation rental accommodations. We also help owners/managers advertise and book their rentals through our website. However, we are not a travel agency and we do not provide or own travel services or accommodations ourselves. When you inquire or book a vacation rental, you will be dealing directly with owners/managers, including the rental, refund, and cancellation policies of each owner/manager.
  2. We collect guest reviews from travelers who have stayed in vacation rentals. If you are submitting a review, we’ll protect your privacy and we will have the right to publish and use your review.
  3. We protect our brand, content, website, and users. If you are trying to do something bad to us or our users, it’s prohibited, and we limit our liability from and disclaim the bad things people may do.
  4. Each week, thousands of people use Beeroom to find great vacation rentals, list their own vacation homes, and help other travelers by submitting reviews about their rental experience. It works.

1. Registration

In order to register on the Web Platform, the User must complete the fields of the registration form with complete and accurate data. In the event of an incomplete or incorrect declaration, the User’s profile may be closed, as of right, without notice and without prior formality. As such, the User guarantees Agostay against all consequences that may arise from this incomplete or incorrect declaration. The User declares to have the capacity to contract. The Minor User guarantees to have received the authorization of his parents or the person holding parental authorization.

The creation of a profile by the User is done using the e-mail address that he has communicated to Beeroom.
During subsequent visits, the User will only need to enter his e-mail address (used as a connection identifier) and his password. For security and confidentiality reasons, the User is recommended to choose passwords made up of at least 8 different characters (upper case, lower case, numbers …), and to change them regularly.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner el_id=”two”][vc_column_inner][vc_column_text]

2. User Profiles

The personal profile of each User allows him to update his data. The username and password are unique and personal. They should not be disclosed to third parties. Any use of the Web Platform made by means of a User ID and password will be deemed to have been made by said User. In case of disclosure of his username and password, the User must contact dpo@beeroom.fr as soon as possible so that they are deactivated. Each User is free to fill in all the fields that are made available to him on the Web Platform. As such, he declares and guarantees that all the elements he mentions are accurate and verifiable and that he is authorized to use and distribute them on the Web Platform. In particular, the User guarantees Beeroom against any complaint or appeal based on the fact that one of the elements that the User disseminates via his personal profile infringes the rights of a third party.

2.1 Host Profiles
The creation of a Host profile makes it possible to publish rental announcements relating to one or more Accommodation (s) on the Web Platform. The Host must be able to lease the Accommodation either as an owner, or as a tenant with the right to sublet or as an agent duly authorized by the owner of the Accommodation under a mandate contract. By registering, each Host expressly gives a mandate to Beeroom to receive and hold the payments and remittances of funds made by a Tenant by virtue of the rental of a Accommodation in accordance with the provisions of Law No. 70-9 of January 2, 1970 and of its implementing decree n ° 72-678 of July 20, 1972.

2.2 Tenant Profiles
The Tenant profile allows its holder:
– select and book Accommodation on the Web Platform;
– to conclude the rental contract for the Accommodation directly via the Web Platform;
– to pay online via the Web Platform the full price of the rent as well as the various taxes and charges relating to the rental of the Accommodation;

3. Accommodation Advertisement

3.1 Content of the advertisement
From registration, the Host may offer Accommodation by posting an advertisement via the Web Platform so that Beeroom validates the advertisement with a view to its publication on the Web Platform.

In order to validate his advertisement online and thus be able to receive Tenants, the Host must mention in his advertisement all the information relating to the Accommodation, including in particular its area, location, characteristics, equipment, availability and price. . As such, the Host agrees that the Accommodation rental offer is existing and in accordance with the description he has made of the Accommodation.

In addition, the Host also undertakes, once the Accommodation announcement has been validated and published on the Web Platform, to regularly check its content and availability via its calendar and to update it in the event of changes in the characteristics of the Accommodation, work, moving or other unavailability. The photographs of the Accommodation published on the Web Platform must be accurate and correspond to the Accommodation concerned. In addition, any photograph published on the Web Platform must in no way infringe any intellectual property right of which a third party may be the holder.

The advertisement must contain the rental price of the Accommodation as well as any additional costs and charges foreseen by the Host (water, electricity, telephone), which are included in the final price mentioned in the advertisement.

3.2 Validation of the Housing announcement by Beeroom
Prior to its publication on the Web Platform, the Accommodation rental advertisement proposed by a Host will be subject to validation by Beeroom.
Once the Housing rental advertisement has been validated by Beeroom, it is published on the Web Platform as soon as possible.
The publication of an advertisement on the Web Platform does not constitute, on the part of Beeroom, neither the commitment nor the assurance of a minimum occupancy rate of the Accommodation, nor of income for the Host, nor only the description of the Housing conforms to reality.

3.3 guarantees
The Host is solely responsible for the content relating to the Accommodation advertisement that he publishes on the Web Platform (e.g., description, photographs, characteristics, environment, Accommodation equipment).

Consequently, each Host posting an Accommodation advertisement declares and guarantees:
(i) that the announcement of the rental of Accommodation and / or its reservation does not violate (s) any agreement or convention entered into with a third party such as in particular a rental contract, a co-ownership regulation or an agreement concluded with a union council;

(ii) comply with and comply with the laws and regulations applicable to Housing and its rental, such as, in particular, tax obligations, town planning laws, laws and regulations relating to the rental of furnished accommodation. In this context, Beeroom makes available to Hosts, who undertake to read it, a page relating to the applicable legislation which allows them to be referred, without this exempting each Host from finding out about the obligations and / or canvass them for which it is responsible;

(iii) have made the mandatory administrative declarations for the rental of the Accommodation. As such, the Parties have agreed that prior to the publication of the Accommodation rental offer on the Web Platform, the Host must take care of all the formalities and declarations prescribed by law and regulations relating to the rental of Accommodation to the competent authorities and must therefore, for each advertisement, declare on honor that these obligations have been met in accordance with the provisions of Article L. 324-2-1 of the Tourism Code;

(iv) the Accommodation exists and has a physical address;
(v) that the description of the Accommodation is sincere, accurate and true. Beeroom can in no way be held responsible for the consequences arising from non-compliance and / or non-compliance by the Host with the guarantees set out above.

3.4 Exclusivity granted by Users to Beeroom
Any Housing rental contract, the advertisement of which has been published, must be concluded exclusively via the Web Platform.
As part of the use of the Web Platform, each User undertakes not to divert other Users with a view to entering into a rental contract relating to Accommodation outside the Web Platform.
As a result, Users refrain from negotiating and directly negotiating the rental of Accommodation with each other.
In the event of non-compliance by a User with his obligation under this article 3.4, Beeroom reserves the right to remove from the Web Platform the Housing advertisement concerned and / or terminate the profile of the User concerned and / or initiate any legal action against the latter.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner el_id=”four”][vc_column_inner][vc_column_text]

4. Reservation and Cancellation

4.1 Booking conditions and modalities
Any booking of Accommodation must be made via the Web Platform.
The duration of the reservation of an Accommodation is between one (1) night and ninety (90) nights per Accommodation and per person, except where the applicable legislation allows derogation.
The reservation request must be accepted by the relevant Host within seventy-two (72) hours. The acceptance or rejection of the reservation will be notified to the Tenant by email.
In the absence of acceptance by the Host, no reservation can be made. If a reservation request is accepted by the Host, the Host and the Tenant concerned will enter into the rental contract relating to the Accommodation online via the Web Platform. Each party to the rental agreement will receive their copy of said agreement by email as well as on their user profile. The reservation is only confirmed upon receipt by Beeroom of the payment made by the Tenant.

4.2 Tenant’s commitments linked to the reservation
The Tenant is required to return the Accommodation in the condition in which it was when he entered the premises. In the event that the Accommodation is returned in poor condition (e.g., cleanliness, incomplete inventory, non-compliance with the rules), an amount corresponding to the damage will be retained from the security deposit. The Tenant is informed that, except special conditions which will be brought to his attention before entering the Accommodation, the state of the places of entry and exit will be drawn up contradictorily between him and the Host, without Beeroom intervening . Beeroom is likely to provide the Tenant and / or the Host with documents intended to facilitate the inventory of fixtures, without taking part in it. In any event, Beeroom cannot be held liable for any event related to the lack of clothing, any errors or omissions or the difficulties of establishing an entry and / or exit inventory. .
The Tenant will be responsible for all damage and deterioration caused to the Accommodation he has occupied. In addition, the Tenant agrees to vacate the Accommodation on the date provided for in the rental agreement. Failing that, he undertakes to pay the occupancy compensation fixed by the rental contract.

4.3 Cancellation of the reservation
Except in cases where special conditions for canceling the reservation of Accommodation are expressly communicated by the Host to the Tenant after having informed Beeroom (eg, within the advertisement), the conditions for canceling the reservation apply. between Users are those defined in this article 4.3.
In the event of cancellation of the reservation by either User, this User who initiated the cancellation will have to pay a cancellation fee calculated as follows:
– More than fourteen (14) days before the expected date of the Tenant’s entry into the Accommodation, only the service charges (see article 5.3 below) must be paid by the User who wishes to cancel the reservation;
– between fourteen (14) and seven (7) days before the expected date of the Tenant’s entry into the Accommodation: twenty-five percent (25%) of the total amount of the rent as well as the amount of the service charges;
– between seven (7) and three (3) days before the expected date of entry of the Tenant in the Accommodation: fifty percent (50%) of the total amount of the rent as well as the amount of service charges;
– less than seventy-two (72) hours before the scheduled date of entry of the Tenant in the Accommodation: seventy-five percent (75%) of the total amount of the rent as well as the amount of service charges.
In the event of cancellation of a reservation, the Renter will be refunded the full amount paid by him, less the cancellation fees referred to above, if applicable.
On presentation of the appropriate supporting documents, Beeroom may decide not to apply the cancellation fees when this occurs as a result of one of the following events:
(i) death of the User; (ii) force majeure (as defined in Article 13.2 below); and / or (iii) destruction of the Accommodation.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner el_id=”five”][vc_column_inner][vc_column_text]

5. Financial Conditions

5.1 Prices
The prices are indicated in euros or in the currency applicable to the domicile of the Tenant (American dollars, Swiss francs, pounds sterling, yuan). The prices indicated include the rent (including common charges and individual charges), service charges, tourist tax, additional tax to tourist tax (if applicable) and payment authorization (ie, guarantee not debited by imprint of the Renter’s credit card). Once the reservation request has been accepted by the Host, the latter will not be able to modify the rental price of the Accommodation for the reservation concerned.
The collection and holding of the sums paid by the Tenant will give rise to the establishment of a receipt by Beeroom.
All the sums paid by the Tenant for the reservation will be collected by Beeroom which keeps them as escrow. Beeroom will repay the sums due to the Host as soon as possible after the Tenant enters the Accommodation concerned. As such, the Tenant gives an express mandate to Beeroom to pay the sums due to the Host concerned subject to his entry into the Accommodation in accordance with the rental agreement.

5.2 Tourist tax and additional tax to the tourist tax
Beeroom has set up a system for referencing the tourist tax and the additional tax to the tourist tax applicable in various municipalities subject to them located in the territory of the France.
The tourist tax and the additional tax to the tourist tax, if applicable, applicable to the rental of Accommodation located in a municipality referenced by Beeroom will, when possible, be paid directly by the Tenant when paying for the reservation and collected by Beeroom. This will pay the tourist tax and additional tax, if applicable, to the municipality concerned.
In the event that the municipality in which the Accommodation is located is not referenced by Beeroom, the Tenant and the Host will be personally responsible for the collection and transfer to the municipality of the tourist tax and the additional tax to the stay.

5.3 Service charges collected by Beeroom

– At the expense of the Tenant:
In remuneration of the services and services provided through the Web Platform, Beeroom will receive decreasing fees depending on the rental period, namely:

  • 15% of the total rental amount of the Accommodation concerned excluding tourist tax for a stay of 1 to 2 nights
  • 13% of the total rental amount of the Accommodation concerned excluding tourist tax for a stay of 3 to 29 nights
  • 10% of the total rental amount of the Accommodation concerned excluding tourist tax for a stay of 30 to 59 nights
  • 8% of the total rental amount of the Accommodation concerned excluding tourist tax for a stay of 60 nights to 90 nights.

The amount of the fees collected by Beeroom will appear on the reservation and will be communicated to the Tenant prior to it, so that the Tenant can have full knowledge of the total cost of his stay prior to his booking confirmation.

By making the booking confirmation, the Tenant accepts purely and simply the fees due to Beeroom and expressly authorizes him to deduct his fees from the amount paid.

– At the expense of the Host:
On each booking confirmation, Beeroom will charge a decreasing fee depending on the rental period, namely:

  • 5% of the total rental amount of the Accommodation concerned, excluding tourist tax.

As necessary, Beeroom confirms that this rate will only be applicable for the private guest; any professional host being exempt from fees.

The private guest will be able to check the amount of fees paid to Beeroom in the invoice established for each rental, and that he can consult on the Web Platform in the “reservations” tab of his profile.

5.4 Payment terms
When requesting a reservation, the Tenant pays for the rental of the Accommodation by credit card (Visa, Eurocard-Mastercard and American Express) via the secure payment system Wise. The Host has seventy-two (72) hours to validate the reservation request. It is only once the reservation request has been validated that the Tenant is debited with the amounts corresponding to his reservation.
The Tenant guarantees Beeroom that he has the necessary authorizations to use the chosen method of payment to pay for the reservation.
Upon receipt of payment from the Tenant by Beeroom, the latter instructs Wise to pay the Host the sums due to him.
Beeroom implements all necessary means to ensure the security and confidentiality of data transmitted online. The transaction takes place through the Wise payment system, which alone has the banking information provided at the time of payment. Beeroom reserves the right to suspend and cancel any reservation in the event of refusal of authorization of payment by credit card or in the event of non-payment. Beeroom reserves the right in particular to refuse a reservation from a Tenant who has not fully or partially settled a previous reservation or with whom a payment dispute is in progress.[/vc_column_text][/vc_column_inner][/vc_row_inner][vc_row_inner][vc_column_inner][vc_column_text]

6. Intellectual Property

The Web Platform is the exclusive property of Beeroom. Beeroom grants the User a free, personal, non-exclusive and non-transferable right to access and use the Web Platform within the limits defined in the General Conditions. Any content not uploaded by the User, in particular any data, functionality, text, names, designations, image, photographs, graphic element, brands, sounds, is the exclusive property of Beeroom or its licensees. The General Conditions can in no way be interpreted as a transfer of any of the rights of Beeroom. None of these elements may be downloaded, copied, modified, deleted, distributed, transmitted, disseminated, sold, rented, licensed or exploited in any way whatsoever, without the express, prior and written consent of Beeroom or its licensees. .

7. Messaging

7.1 Internal messaging
Registration to the Web Platform gives access to a messaging system, the use of which is reserved for Users.
Messaging consists of a single inbox in which all messages exchanged between two Users are stored. Hosts and Tenants can use this internal instant messaging to compose messages that they can send to each other. Any message will be automatically deleted if the User’s personal profile is deleted. The private internal messaging system made available to Users does not allow messages to be sent to other messaging services.

7.2 Assistance
Registration for the Web Platform provides access to an online assistance service that allows Beeroom to interact with Users. Messaging consists of a single inbox in which all messages exchanged between the User and Beeroom are stored. The use of the assistance messaging allows Users to be assisted, helped and accompanied by Beeroom in the use of the Web Platform. To do this, the User describes the difficulties encountered at Beeroom, which takes care, as far as possible, of answering these questions. 8. User Engagement

As part of his use of the Web Platform, the User agrees to comply with applicable legislation.
In the absence of prior written authorization from Beeroom, it is prohibited:
– insert false or irrelevant information on the Web Platform;
– to publish or transmit on or through the Web Platform content of an illegal, threatening, humiliating, defamatory, obscene, hateful, pornographic or blasphemous nature, or any other message which could constitute a crime or an offense, engage the responsibility civil, infringe the law or incite to do, or content that could be used for any purpose contrary to the law or to these conditions of use;
– to use the Web Platform in such a way that, from our point of view, the performance or the functionalities of the Web Platform, or of any other computer or network system used by Beeroom, are negatively impacted or that the Users of the Web platform are negatively affected;
– upload or transmit on the Web Platform or use any equipment, software or routine that contains viruses, Trojans, worms, time bombs or other programs and processes intended to damage, interfere or attempt to interfere with normal operation of the Web Platform, or appropriate the Web Platform, or even resort to any means to cause saturation of our systems or infringe the rights of third parties;
It is recalled that Articles 323-1 et seq. Of the Penal Code punish with penalties of up to five (5) years’ imprisonment and a fine of 150,000 euros, in particular:
– fraudulent access and maintenance in an automated data processing system;
– fraudulent deletion, modification or addition of data in this system;

9. Protection of Personal Data

9.1 Collection of personal data
Beeroom, in its relations with the User, is required to process, for its own account, the personal data of the User, which data
(i) were communicated to him by the latter during his registration or
(ii) subsequently via his personal profile on the Web Platform.
Data for which communication to Agostay is mandatory is identified as such when registering the User and / or booking Accommodation.
Except on request or with the express consent of the User and in strict compliance with its directives, Beeroom will not proceed to any other processing of personal data other than those described in this Article 9 “Protection of personal data” .

9.2 purposes of processing
The personal data collected by Beeroom are processed for the following purposes: – Connection and use of the Web Platform, including consultation of the information accessible therein; – posting of rental advertisements for Accommodation; – the reservation of Accommodation; – the online conclusion of the rental contract for the Accommodation; – dissemination of advertising messages via the Web Platform; – sending, by e-mail, information on products or services similar to those offered by Beeroom; – sending, by email, messages, bulletins or newsletters from Beeroom; – and any other use that improves the functioning of the Web Platform and / or any other service provided by Beeroom.

9.3 Your rights
All personal data that you communicate to Beeroom is strictly confidential. They are necessary for the use of the Web Platform and / or the reservation of Accommodation. The User has the right to access, rectify, delete and oppose the processing of his personal data by Beeroom. To exercise one of his rights, the User just has to use the profile management tool offered to him, or write to the following address dpo@beeroom.fr indicating his surname, first name and email address. At any time, the User can access and update his personal data, or delete his profile and the attached personal information using his username and password. In accordance with the law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal data collected by Beeroom has been declared to the National Commission for Computing and Freedoms.

9.4 Data retention
The data collected on Users are kept by Beeroom for the duration of their registration on the Web Platform. Unless expressly stipulated otherwise in the General Conditions, the closure of a User’s personal profile results in the deletion of all personal data enabling the User concerned to be identified, except for those whose retention by Beeroom is necessary in order to that it is able to fulfill its legal obligations (eg, invoicing data, identification of the authors of content, provision of the guarantee). As part of the reservation of Accommodation, Beeroom is likely to keep the data relating to the User for a period going beyond the closing of the personal profile of this User, in particular to respect its obligations relating to the collection. payments and / or to allow the provision of evidence throughout the legal limitation period.

9.5 Data recipients
In certain specific circumstances, Beeroom may be required to disclose your personal data, when these are required by the judicial authorities.
Your personal data, and in particular e-mail addresses, are not subject to any rental, sale, exchange or sharing with other service providers if you have not expressly agreed to receive promotional offers from other companies that may be of interest to you.

9.6 Cookies

11. Termination

– the loss, misappropriation or unauthorized or fraudulent use of the username and password by the User;
– the provision on the Web Platform of illegal content or contrary to the General Conditions;
– any breach on the part of the User of his obligations under the General Conditions.

Beeroom reserves the right to interrupt, at any time, temporarily or permanently, access to the Web Platform. In the event of a definitive interruption, the User will be informed by any relevant means determined by Beeroom.
Beeroom cannot under any circumstances be held liable against the User or against third parties for the termination and / or suspension of the User profile under the conditions provided for in this article.

12. Guarantee – Liability

The Host, acting as a professional, acknowledges that the Web Platform is provided “as is” and that as such he can not seek the responsibility of Beeroom for any damage, direct or indirect, (eg, negative consequences delay) regardless of the basis, which may be caused by the use of the Web Platform and waives any compensation for this fact. If a pecuniary conviction should be pronounced against Beeroom and this, for any reason whatsoever, the Parties expressly agree that the amount of said conviction may not exceed one hundred euros (100 €), which the Parties are ” agree to consider as fair compensation with regard to their respective commitments under the General Conditions.

In any event, Beeroom does not guarantee the absence of bugs and therefore does not guarantee that the use of the Web Platform will be uninterrupted and error-free. 13. Various

13.1 Modification of the General Conditions
Beeroom reserves the right to make any changes it deems necessary and useful.

They will also be accessible by the User in his personal profile as well as on the Web Platform. The User who has not expressly accepted the new general conditions may terminate his profile in accordance with the provisions of article 12 of the General Conditions.

13.2 Force Majeure
Each of the Parties cannot be held liable in the event that the performance of its obligations is delayed, restricted or made impossible due to the occurrence of a case of force majeure, as defined by case law, or of a fortuitous event (hereinafter “Force Majeure”). 13.3 Waiver
The fact that one or the other of the Parties does not exercise any of its rights hereunder shall not constitute a waiver on its part of its exercise, such waiver being able to proceed only from an express declaration. of the Party concerned.

13.4 Convention of proof
The computerized registers will be kept in the computer systems of Beeroom under reasonable security conditions and will be considered as proof of exchanges, orders and payments made on the Web Platform or by email.

13.5 Partial invalidity
In the event that one or more stipulations of the General Conditions are considered invalid by a competent court, the other clauses will retain their scope and effect.
